Judgment
Arindam Lodh, J
Heard Mr. K. Chakraborty, learned counsel appearing for the applicant. Also heard Mr. Raju Datta, learned PP appearing for the respondent-State.
Apprehending arrest in connection with Dharmanagar Women PS case No. 25 of 2024 registered under Sections 69/115(2) of the BNS, 2023, the applicant, namely, Partha Das, has filed by the instant pre-arrest bail application under Section 482 of BNSS, 2023.
In the complaint, it is alleged that the applicant on false assurance of marriage had sexual intercourse with the complainant-victim.
Mr. Datta, learned PP has sought for an accommodation to produce the case diary.
Mr. Chakraborty, learned counsel for the applicant has submitted that the applicant is ready and willing to marry the complainant-victim lady, but, the complainant-victim lady had deceived the applicant and lodged a false complaint against him and thus, he has prayed for an interim protection till production of the case diary.
Considering the nature of the complaint, I am inclined to grant anticipatory bail to the applicant, namely, Partha Das, as an interim measure till 08.10.2024.
Accordingly, I direct that in the event of arrest, the applicant, namely, Partha Das, may be released on interim bail till 08.10.2024 on executing a bond of Rs. 25,000/- with one surety of the like amount to the satisfaction of the arresting authority.
List the matter on 08.10.2024.
On the next date learned PP shall produce the case diary in connection with the instant case.
