Judgment
A.S. Pachhapure, J.—The facts reveals that the daughter of accused No. 17 by name name Ambika had a lover affair with Raja @ Rajashekara, the brother of the complainant. It is on 25.02.2011 Ambika eloped with her lover and in this regard, it is alleged that on 25.02.2011 at about 9.00 p.m. the Petitioners and other accused gained entry into the house of the complainant and took away golden ornaments, T.V., cash amount of Rs. 5,00,000-00, another sum at Rs. 3,00,000-00 etc. and gave a threat of danger to the life. It is under these context, the complaint is filed for the offence punishable under Sections 143, 147, 448, 324, 427, 506, 395 r/w. 149 of IPC and u/s 2(a) of Destruction and Loss of Properties Act.
I have heard the learned Counsel for the Petitioners and also the learned Government Pleader.
The learned Counsel for the Petitioners submits that all the family members have been arrayed as accused.
As could be seen from the petition, the 1st Petitioner is aged about 62 years, the 3rd Petitioner is aged about 63 years and Petitioner No. 7 is aged about 55 years and some of the Petitioners are aged about 20 and 23 years and the incident has taken place in view of the elopement of the daughter of accused No . 17 with the brother of the complainant. So, taking into consideration these circumstances, I am of the view that this is a fit case wherein anticipatory bail is to be granted.
In the result, the Petition is allowed. The Petitioners are ordered to be released on bail in the event of their arrest, on their executing a personal bond for a sum of Rs. 50,000 each with one solvent surety each for the likesum to the satisfaction of the arresting authority with further following conditions:
1) The Petitioners shall appear before the Police station concerned, within 7 days from today.
2) They shall be made available for interrogation by a police officer as and when they are required.
3) They shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer.
4) They shall attend the Court as and when directed.
5) They shall appear before the concerned Police Station on every Sunday and Thursday in between 10.00 and 11.00 a.m. till filling of the charge sheet.
