This petition has been filed under Article 226 of the Constitution of India seeking issuance of a writ in the nature of Habeas Corpus directing the official respondents No.1 to 3 to get the detenue namely Monika wife of Partap be released from the illegal custody of respondents No.4 and 5.
This Court vide order dated 15.10.2025 directed respondent No.3 to appear along with alleged detenue in the Court as well as respondents No.4 and 5.
Today, Monika, the alleged detenue along with her father Krishan Lal (respondent No.4) is present in the Court. Monika wife of Partap has been identified by SI Jugraj Singh, who is present in the Court.
Monika has given a statement in the Court today that she is staying with her father (respondent No.4) and brother (respondent No.5) at her own will and she is not in their illegal custody.
In the light of the statement given by Monika, the alleged detenue, in the Court today, no further orders are required to be passed in the present petition.
The present petition stands disposed of.
