Vide this application (CM-8246-CWP-2022), respondent No.5 in the accompanying petition, i.e. the allottee (complainant before the Real Estate Appellate Tribunal, Haryana), seeks an early date of hearing in the accompanying petition.
However, at the outset, Ms. Ritika Garg, Advocate, appears for Mr. Gunjan Rishi, Advocate, and submits that in view of the judgment of a co-ordinate Bench of this court passed in “Ramprastha Promoters and Developers Pvt. Ltd. vs Union of India and others (CWP No.6688 of 2021, decided on 13.01.2022), the petitioners do not press this petition.
Mr. Mittal, learned counsel for the respondent-RERA, also submits that other than the aforesaid judgment, the matter would also be covered by the ratio of the judgment of the Supreme Court in “M/s Newtech Promoters and Developers Pvt. Ltd. vs State of UP & Ors. Etc.
(Civil Appeal No.6745-6749 of 2021, decided on 11.11.2021), as also the judgment of this court in “Experion Developers Pvt. Ltd. vs. State of Haryana (P&H)(DB) 2021(1) R.C.R.(Civil)1.
