The petitioner is seeking regular bail in FIR No. 660 dated 03.10.2017, registered under Sections 363, 366-A, 120-B IPC and Section 6 of the POCSO

Act, Police Station Samalkha, District Panipat.

Heard.

Counsel for the petitioner urges that charge has been framed and no PW has been examined so far and the petitioner is in custody since 05.10.2017

and the trial will take time. Counsel contends that no allegation of rape has been levelled against the petitioner and the only role attributed to him is

that he was standing outside the room. Counsel further contends that the petitioner has been falsely implicated and the FIR was lodged after two

days of the incident.

The State counsel has opposed the bail application but does not dispute the fact that the witnesses have not been examined.

Challan has been presented, charge has been framed. The trial will take long time to conclude. Without commenting upon the merits of the case, the

petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal and surety bonds to the satisfaction

of trial Court, subject to the condition that he will not tamper with the evidence.
