Parmanand Sahu vs State of C.G.

Prashant Kumar Mishra, J.—The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 183/2013 registered in Police Station Palari, (Police out post Chauki Gidhpuri) Civil District Raipur, Revenue District Baloda Bazar-Bhatapara (C.G.) for offence punishable u/s 354, 456 of the Indian Penal Code and Section 3(1)(11) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. Applicant has allegedly outraged the modesty of the prosecutrix aged about 30 years after committing house trespass at about 9.30 p.m. on 6/07/2013.

Learned State counsel would oppose the prayer for grant of bail.

Considering the fact that the applicant is in jail since 19/07/2013; the investigation is complete as the charge sheet has already been filed and the trial may take some time to conclude, this Court is inclined to release the applicant on bail. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs. 25,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial court on each and every date given by the said Court.
