Adarsh Kumar Goel, J.—This petition for quashing has been filed alleging that there was civil litigation between the parties and injunction was granted in favour of the Petitioner. The complainant who was Defendant in the suit filed two FIRS against the Petitioner to wreak vengeance. Against the other FIR, Crl. Misc. No. 9662-M of 1994 had been filed in this Court.

Vide order dated 7.7.1994, while issuing notice and granting stay, it was directed that this petition be put up along with Crl. Misc. No. 9662-M of 1994. However, a perusal of record of Crl. Misc. No. 9662-M of 1994 shows that vide order dated 10.8.1994 the said petition has bee allowed and proceedings quashed, inter alia, on the ground that the complainant who was Defendant in the suit had filed the FIR only to wreak vengeance. In the present petition also this is the main ground put forward for quashing To maintain parity, following the order passed by this Court on 10.8.1994 in Crl. Misc. No. 9662-M of 1994, this petition is also allowed and proceedings are quashed.
