The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent to grant him pension on compassionate ground.
The petitioner was enrolled in Punjab Home Guards. He rendered five years continuous service during militancy in the state. He sustained two bullet injuries in an encounter with terrorist on 17.11.1990. He was admitted in Hospital. He became permanently disabled and bed ridden. His son was granted compassionate appointment after 2018 but no financial assistance in the form of pension has been released to him. He has made multiple representations to respondents but to no avail.
The petitioner was part of Punjab Home Guards. He remained in service for 05 years. He was called off in 1990. A period of more than three decades has passed away and he is claiming financial assistance in the form of pension which is not recognized by Rules applicable to members of Home Guards. The petitioner has failed to advance any plausible reason for inordinate delay as well as has failed to point out any particular Rule providing for pension to a former member of Home Guards.
Dismissed.
