Rule. Mr.Devnani, learned Additional Public Prosecutor waives service of notice of Rule on behalf of respondent State.

Heard Ms.Dharti Shah, learned advocate for the applicant and Mr.Devnani, learned APP for the respondent â€" State.

Ms.Shah, learned advocate for the applicant submitted that the present application has been preferred by the applicant for extension of time to

surrender before the jail authority. She submitted that vide order dated 04.11.2020 passed in Criminal Miscellaneous Application No.1 of 2020 in

Criminal Miscellaneous Application No.4917 of 2020, this Court extended temporary bail granted to the applicant till 05.11.2020 and the applicant was

due to surrender on 05.11.2020. However, since the applicant was tested Covid-19 positive, he was advised to remain home quarantined till

21.11.2020 and, therefore, by way of present application, the applicant has prayed for extension of time to surrender.

On perusal of the record produced along with the application, I am of the view that since the applicant was advised to remain home quarantined for

a period of 14 days, being tested Covid-19 positive and the said period expires on 21.11.2020, the applicant is directed to surrender before the jail

authority on 22.11.2020. The period between 05.11.2020 to 22.11.2020, during which applicant could not surrender, shall stand condoned.

With the above direction, the present application is disposed of. Rule is discharged.
