Judgment
Viney Mittal, J.—The plaintiffs are in appeal. Their suit for specific performance of the agreement dated April 29, 1994 alleged to have been
executed by Uttami Devi, defendant No. 1 was decreed by the learned trial Court and an appeal filed by the defendants was accepted by the
learned first Appellate Court. Consequently, the suit filed by the plaintiffs stood dismissed.
The plaintiffs have now chosen to file the present appeal.
It is not in dispute that Uttami Devi, defendant No. 1 was grandmother of the plaintiffs. The learned first Appellate Court has taken into
consideration that aforesaid Uttami Devi was aged 95 years and was an illiterate lady and as such a finding has been returned by the learned first
Appellate Court that the execution of document, Exhibit P1 was surrounded by suspicious circumstances.
Nothing has been shown that the findings recorded by the learned first Appellate Court suffer from any infirmity and are contrary to the record.
No question of law, much less, substantial question of law arises in the present appeal.
Dismissed.
