Application is allowed and the main petition is taken up for hearing today itself.
Main case
The petitioner has filed the present petition under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail in case FIR No. 240
dated 04.12.2019 registered under Sections 22 and 61 of the Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station Passiana,
District Patiala.
As per the allegation made in the FIR, 43 strips containing 430 capsules of Parvon-Spas Plus (Tramadol Hydrochloride, Dicyclomine Hydrochloride
and Acetaminophen) were recovered from the motorcycle on which the petitioner and his co-accused Amanjot were riding. The total weight of the
recovered contraband comes to 316 grams.
Learned counsel for the petitioner states that no other case under the NDPS Act is registered against the petitioner. The petitioner has been in
custody for the last one year. Challan has been presented.
The trial of the case is likely to take long time in view of COVID-19 pandemic. No useful purpose will be served by keeping the petitioner behind the
bars till the conclusion of trial.
Without commenting anything on the merits of the case and also bearing in mind the custody period of the petitioner, this criminal miscellaneous
petition is allowed and the petitioner-Pardeep Kumar is ordered to be released on bail subject to his furnishing bail bonds and surety bonds to the
satisfaction of the trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
