Judgment
ORDER
Ms. Jyoti Muley, counsel appearing for the Operational Creditor, along with RP Mr. Mahesh Sureka, appeared in person through virtual hearing.

The above Interlocutory Application has been filed by the RP seeking cooperation from the Ex-director/promoters under section 19(2) of the IBC.
The counsel for the RP mentions that the necessary record data relating to the corporate debtor company has not been handed over to the RP by the Ex-promoter/directors during the previous hearing on 01.01.2021 it was mentioned by the RP that Ex-promoter/directors are untraceable.
The bench today briefly heard the RP and the counsel for the RP and arrived at a conclusion that in the event Ex-promoter/directors are not traceable, the RP may obtain whatsoever information is there in public domain including Ministry Of Corporate Affairs record etc. Besides the RP in the event so decides may make the statutory auditors for the past year of the corporate debtor as respondent to seek necessary information from them regarding the financial data etc. of the corporate debtor. List this matter on 14.12.2021 for further hearing.
