Petitioner seeks anticipatory bail in case vide FIR No.93 dated 27.05.2026 under Sections 109, 115(2), 118(1), 117(2), 333, 191(3), 190, 303(2) of Bharatiya Nyaya Sanhita, 2023 and Sections 25, 27, 54, 59 of Arms Act, Police Station Mehta, Amritsar. Section 109 and 117(2) were added in the FIR during investigation. This is the first petition for anticipatory bail.

On 19.08.2026, following order was passed:

The facts, as noticed by learned Additional Sessions Judge, Amritsar, in his order dated 01.08.2026, regarding which no dispute has been raised, are as follows: "As per allegations, FIR this under Sections 109,115(2),118(1), 117(2),333,191(3), 190, 303(2) of BNS and 25,27,54,59 of Arms Act has been registered on the basis of statement of complainant Kawaljit Kaur to the effect that on 27.05.2026, she, her brother Sharanjit Singh, mother Paramjit Kaur, father Sardool Singh, sister-in-law Gurpreet Kaur and nephew Gurshanveer Singh were present in the house. At about 03.30 PM, Sandeep Singh applicant-accused armed with hockey, his co-accused Gurmit Kaur armed with empty handed, Paramjit Kaur armed with baseball, Harsadeep Singh armed with baton, Amrit armed with baton, Ranjit Singh armed with datar alongwith 5-6 other unknown persons entered in their house. Gurmit Kaur raised lalkara to teach them a lesson for returning back the car Upon this, Sandeep Singh gave hockey blow upon her father which hit on his left arm as he raised his left arm to save himself. Ranjit Singh gave datar blow on the head of her father. Her mother Paramjit Kaur came forward to rescue them. Then, Paramjit Kaur wife of Sandeep Singh gave baseball blows upon left arm of her mother. In the meantime, her brother Sharanjit Singh came out from inside Sandeep Singh alongwith his companions also tried to give injuries upon Sharanjit Singh but her brother Sharanjit Singh ran towards outside the house. Sandeep Singh took away mobile phone of her father make Realme touch screen and mobile phone of her mother make 1-phone-12 which were lying on the bed in the room."

Learned counsel for the petitioner inter-alia submits that petitioner was innocent and was falsely involved in the case on account of enmity Cross version vide GD No. 24 dated 10.06.2026 was registered against the complainant party on statement of Nishan Singh son of Harbans Singh. Infact, petitioner was herself a victim and had suffered 5 injuries at the hands of complainant side The only allegations against her in the FIR was a blow with base ball bat to mother of the complainant. The dangerous injury was said to have been suffered by father of the complainant Petitioner had no criminal antecedents and was ready and willing to join investigation, therefore, she may be enlarged on anticipatory bail.

Mr Kunwarbir Singh, AAG Punjab, who is present in the Court accepts notice on behalf of respondent-State and opposes the prayer for anticipatory bail in view of serious nature of allegations and infliction of dangerous injury to father of the complainant. He, however, concedes that only simple injuries are attributed to the petitioner.

In the given facts and circumstances of the case, in the event of arrest, petitioner shall be released on interim anticipatory bail subject to her furnishing personal and surety bonds to the satisfaction of the Arresting/Investigating Officer Petitioner shall join investigation as and when called upon to do so and shall abide by the conditions as envisaged under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.

Learned State counsel on instructions from ASI Gurpartap Singh submits that petitioner has joined investigation and is no longer required for custodial interrogation.

Petitioner has joined investigation pursuant to order of this Court dated 19.08.2026 and his further custodial interrogation is not required. In the circumstances of the case but without commenting on merits, the petition is allowed and order dated dated 19.08.2026, granting interim anticipatory bail to the petitioner, is made absolute, subject to the conditions laid down in Section 482(2) of Bharatiya Nagrik Suraksha Sanhita (BNSS), 2023.
