RAJ MOHAN SINGH, J.(ORAL)

Petitioner seeks issuance of necessary directions to the respondents for conducting investigation in the case so as to point out cause of death of

husband of the petitioner.

The husband of the petitioner left his home in the evening of 22.03.2017 and later on, it came to be known that he had died and his dead body was

found lying on a railway track within the jurisdiction of Railway Police Station, Lalru. The dead body was mutilated and beheaded. Personal

belongings of the husband of the petitioner were missing and that gave rise to a suspicion in the mind of the petitioner in respect of cause and manner

of death of husband of the petitioner. A mobile phone of the deceased became functional in Rajasthan and the same was found in possession of

respondent No.6. On being confronted, respondent No.6 could not give any satisfactory reply as regards possession of the mobile.

Petitioner alleges inadequacy of investigation/inquiry despite filing complaint before the competent authority and representation before Additional

Deputy General of Police (Railway), Punjab, Chandigarh.

Notice of motion.

On the asking of Court, Mr. Hittan Nehra, Addl. A.G., Punjab, accepts notice on behalf of respondents No.2 to 5.

In view of nature of order, which this Court proposes to pass there is no necessity of filing any reply, as no order prejudicial to the interest of either

party is being passed.

At this stage, without embarking upon merits of the case, this petition is disposed of with a direction to respondent No.3 to look into the

representation of the petitioner and decide the same in accordance with law without being influenced by any statement of fact made hereinabove.
