Judgment
I.A. No. 1734 of 2023 has been filed praying for rectification/clarification in the Order/Judgement dated 10th April, 2023 passed in Company Appeal (AT) Ins. No. 06 and 30 of 2023.
In paragraph 6 of the Judgment, we have already made following observation:
“6. Learned counsel for the Appellant has lastly contended that the direction made in Para 17 of the impugned order may also be extended to the Successful Resolution Applicant for further implementation of the plan, as and when required. The Adjudicating Authority has already issued necessary directions, appropriate measures be taken towards the implementation of the plan accordingly. With these observations, we dispose of these appeals.”
The observations made in paragraph 6 itself indicate that the direction in paragraph 17 of the Impugned Order can be availed by Successful Resolution Applicant also. We make it clear that benefit of direction in paragraph 17 of the Impugned Order passed by the Adjudicating Authority shall also be taken by the Successful Resolution Applicant.
With these observations, we dispose of the Application I.A. No. 1734 of 2023.
