The present petition has been filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the petitioner in case bearing FIR No.117 dated 24.04.2023, under Section 174-A IPC, registered at Police Station City Ratia, District Fatehabad.

Learned counsel for the petitioner has submitted that now the custody of the petitioner in the aforesaid FIR is more than 4 months. He further submitted that the investigation of the case has already been completed and challan has also been presented before the competent Court. He submitted that in view of the aforesaid facts and circumstances, the petitioner may also be considered for the grant of regular bail.

On the other hand, Ms. Harpreet Kaur, learned Assistant Advocate General, Haryana, stated that the petitioner is in custody for more than 4 months and now challan has been presented before the competent Court after the completion of investigation.

After hearing the learned counsels for the parties, this Court is of the view that since in the present bail petition the offence is under Section 174-A IPC regarding which the petitioner has already faced incarceration for more than 4 months and after completion of the investigation, challan has already been presented before the competent Court and trial of the case may take long time, therefore, it will be just and proper to grant bail to the petitioner.

Consequently, the present petition is allowed and the petitioner is ordered to be released on bail on furnishing bail bond/surety bond to the satisfaction of the trial Court/Duty Magistrate concerned, if not required in any other case.

However, anything observed hereinabove shall not be treated as an expression of opinion on merits of the case and is only meant for the purpose of decision of present petition.
