Judgment
The issue of establishment of slaughterhouse/abattoir has been pending consideration with the authorities over sufficiently long period of time. The Prevention of Cruelty to Animals Act (PCA), 1960, stands notified since long.
It was only when this Court passed the order, calling upon the authorities to state the position with regard to the establishment of the Slaughterhouse, the Commissioner, Aagartala Municipal Corporation, filed an affidavit stating the measures taken in that regard. Advertisements for establishment of one such slaughterhouse, as also sensitizing the people with regard to the provisions of the Act, were issued on 1st December, 2018 and 7th December, 2018.
What has happened thereafter, has not been disclosed.
We may notice, even though the Act does not provide for setting up of State Level Advisory Boards, but pursuant to the direction issued by the Apex Court in WP(C) No. 440 of 2000, titled as Geeta Seshmani vs. Union of India & Others and WP(C) No. 881 of 2014, titled as Gauri Maulekhi vs. Union of India & Others, the State has constituted the Boards, but this was in February, 2018.
As to what is the status of the abattoir/slaughterhouse; constitution of the State Advisory Board; as also the District Level Committee, needs to be ascertained.
Let the Secretary, Animal Resources Development Department [ARDD for short], file his personal affidavit indicating the steps taken in that regard.
Also the Commissioner, Agartala Municipal Corporation, shall file his affidavit with regard to the establishment of the abattoir/slaughterhouse within the municipal limits, to cater to the needs of residents of Municipal Corporation, Agartala.
Such affidavit be positively filed within a period of 1(one) week. let the matter be listed on 24.09.2019.
