This Criminal Original Petition is filed seeking for a direction to transfer the investigation in Crime No.1785 of 2017 on the file of the third respondent and to entrust the same to the fourth respondent.

According to the learned counsel for the petitioner, he has filed a complaint basing on his complaint, the police have registered a case in Crime No.1785 of 2017 for offences punishable under Section454 and 380 of IPC, wherein, 8.5 Sovereigns of gold and Rs.29,000/- of cash were stolen away.

Learned Additional Public Prosecutor submits that though they could able to get two finger prints at the scene of occurrence and they were sent to National Crime Records Bureau, but could not match with their record. Learned Additional Public Prosecutor requested time so that the police will expedite the investigation and report back to the Court.

In a case like this, not detecting since 2017, which is more that 6 years, is really surprising. Police should have taken some strong efforts, formulating certain special teams to investigate the case. Considering the request made by the learned Additional Public Prosecutor, list the matter on 25.08.2023. The police are directed to file a status report in respect of investigate, by then.
