The disposed of writ petition has been listed on necessity of modification to be made in order dated 28th February, 2023, disposing of it. It appears, since the ARBP no.19 of 2022 is pending in the Commercial Court at Bhubaneswar, there was direction to encash the security held in this Court and transmit the same, for being held in favour of the case in the Commercial Court.
The District Judge, Khurda at Bhubaneswar has written letter dated 15th March, 2023 saying that there is no post nor any account in name of Registrar, Commercial Court, Bhubaneswar. Transactions are made in name of Registrar, Civil Courts, KHR BBSR.
Mr. Rout, learned advocate appears on behalf of writ petitioner. On query from Court he submits, notice was had from noting in the list.
Order dated 28th February, 2023 is modified to effect that mention of ‘Civil Judge (Senior Division), Commercial Court, Bhubaneswar’ in paragraph-8 of said order be substituted by Registrar, Civil Court, KHR BBSR.
This order along with said order dated 28th February, 2023 be communicated to the District Judge.
