Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.
The petitioner is in custody since 28.02.2023 in connection with Mahanga P.S. Case No. 57 of 2023 corresponding to S.T. Case No. 61 of 2023 pending in the Court of learned Addl. Sessions Judge, Salipur for the alleged commission of offence under Sections 457/394/307/34 of IPC.
It is alleged that five persons broke into the house of the informant and committed robbery. Further, they took away several valuable articles and assaulted the husband of the informant causing injuries on his head. It is seen that in the meantime, the trial has commenced. Several witnesses have been examined. There is direct allegation of assault by the petitioner on the injured by means of a crowbar. Though co-accused persons have been released on bail, yet the petitioner cannot be said to be on the same footing, in view of the direct evidence against him.
In such view of the matter, I am not inclined to allow the prayer for bail. The bail application is therefore, rejected.
