The Court proceedings have been conducted through video-conference.

Heard Ms. S. Sultana, learned counsel for the petitioner. Also heard Mr. S. Roy, learned Government Advocate, Assam.

The present petition has been filed seeking appointment under the die-in-harness scheme.

The case of the petitioner is that his father was serving as a Havildar in Assam Police Radio Organisation, Ulubari, Guwahati and was on

deputation in the MTO Branch of the office of the Director General of Police, Ulubari as a Dak Runner. The petitioner’s father died on

20.04.2010 though he was due to retire in the year 2014. Thereafter, the petitioner applied for appointment on compassionate ground but his case was

rejected by the District Level Committee (DLC) in its meeting held on 06.06.2012 on the ground that there was no available vacancy. The petitioner

was, however, assured that whenever any vacancy arises in future, his case will be considered.

Learned counsel for the petitioner submits that as per a communication received by the petitioner’s mother on 23.3.2021 from the State Public

Information Officer-cum-Superintendent of Police (Commn), Assam, APRO, HQ-Ulubari, Guwahati, the following posts are now available:-

After hearing the parties and considering the materials on record, this Court of the view that the present petition can be disposed of by directing the

petitioner to file a detailed representation before the authorities seeking appointment under the die-in-harness scheme preferably within a period of two

weeks, and if vacancies are available as stated above, the authorities thereafter, shall consider the case of the petitioner along with other eligible

candidates for appointment under the die in harness scheme in terms of the relevant Office Memorandum and the Rules governing the field as

expeditiously as possible, preferably within a period of two months.

The writ petition is, accordingly, disposed of with the above observation and direction.
