The instant appeal has been filed under Section 14A (2) Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act on behalf of the appellant, who is in custody in connection with FIR No.123/2017, Police Station Bhopalgarh, Jodhpur for the offences under Sections 325, 323/34 of IPC and Sections 3(1)(R)(S), 3(2)(V-A) of SC/ST Act, against the order dated 15.12.2021 passed by the learned Special Judge SC/ST (Prevention of Atrocities) Cases, Jodhpur in Criminal Misc. Case No.405/2021 whereby, the bail application preferred on behalf of the appellant under Section 438 Cr.P.C. was rejected.
After hearing learned counsel for the parties, I am not inclined to grant anticipatory bail to the appellants, hence this criminal appeal is rejected.
However, the appellants are permitted to surrender before the concerned trial court on or before 09.03.2022 and file regular an application for bail. It is expected from the concerned trial court that the bail application of the appellants will be decided in accordance with law on the same day. Till 09.03.2022, the appellants shall not be arrested.
