Judgment
The matter was taken up today through Video Conferencing.
Heard Sh. Sumit Virmani, Advocate for the Applicant/ RP through video conferencing, who has filed the present IA No.152/2021 in CP No.
(IB)381/ALD/2018 U/s 60(5) of IBC for granting extension of six (6) months from 29.11.2020 to 27.05.2021.
It is contended that vide order of this Court dated 08.12.2020, extension of 90 days was granted for completion of CIRP on account of the existing
situation due to Pandemic Covid-19. It is further contended that on account of various actions which are to be taken by the RP, details of which have
been given in para no.11, the present extension is being sought for, which was placed before the CoC in its 5th meeting held on 05.03.2021 and the
said resolution has been passed with 100% of its voting rights. Hence, the present application.
After hearing Ld. Counsel for the Applicant/RP, this Court is of the opinion that the extension as prayed for, is hereby allowed.
Accordingly, the period from 29.11.2020 to 27.05.2021 is extended and the present IA No.152/2021 stands disposed off.
