Judgment
Notice of motion.
At the asking of the Court, Ms. Tanushree Gupta, DAG
Haryana accepts notice on behalf of the State.
Heard forthwith with the consent of learned counsel for the
rival parties.
This is a petition for grant of interim bail to the petitioner
in FIR No.0710 dated 19.11.2015, under Sections 21(b), 27A of the
Narcotic Drugs and Psychotropic Substance Act, 1985 and Sections 18
(A), 18(C) of the Drugs and Cosmetics Act, 1940, registered at Police
Station City Fatehabad, on the ground that the marriage of the sister of
the petitioner is to take place on 26.06.2017.
Vide Para 2 of the impugned order dated 19.06.2017, it has
been observed by the trial Court that the factum of marriage of sister
has been verified by the police and found to be correct. In that view of
the matter, I am inclined to grant interim bail to the petitioner for a
period of one week only from the date of his actual release.
In that view of the matter, in the event of arrest, the
petitioner shall be released on interim bail, for a period of one week
only from the date of his actual release, on his furnishing bail bonds
amounting to `10,000/- with one surety of like amount, subject to the
satisfaction of the Chief Judicial Magistrate/Duty Magistrate
concerned. Petitioner shall not tamper with the prosecution evidence,
threaten or exercise any influence on the prosecution witnesses.
Petitioner shall thereafter, surrender to the custody forthwith on the
expiry of one week.
Petition stands disposed of, accordingly.
