As per the investigation report the Petitioner and another person, co-accused in the present case were riding on a motorcycle. This Petitioner was pillion rider. The case of the Petitioner is that he had absolutely no knowledge that Ganja was carried by the other accused kholbahar whose bail application was rejected by this Court on earlier occasion. It is further stated that except the fact that the Petitioner was riding on the same motor-cycle with the other co-accused there is no other material to connect the Petitioner with the commission of alleged offence. Charge-sheet has been filed on 4.9.2000. Trial has not started as yet. It is submitted that in the facts and circumstances of this case the Petitioner deserves to be releases on bail.
Upon hearing the counsel for the parties and in the facts and circumstances of the present case I allow the prayer of the Petitioner for bail. Petitioner shall be enlarged on bail of Rs. 5000/- with one surety of like amount to the satisfaction of the special Judge NDPS, Raipur. C.c. today.
