Learned Senior Counsel, Mr. P. Roy Barman assisted by Learned Counsel, Mr. S. Bhattachrjee has filed this application under Section 483(3) of BNSS, 2023 for cancellation of bail granted to the accused persons namely, Pradip Nama, Pinku Podder, Manoranjan Tripura, Jogeshwar Das, Bishu Ranjan Das, Babul Chandra Das by Learned Addl. Sessions Judge, South Tripura, Belonia in connection with case No.ST(T-1) 35 of 2024 by order dated 25.07.2025.

Learned P.P., Mr. R. Datta is present for the State-respondent.

At this stage, Learned Senior Counsel drawn the attention of the Court that by order dated 07.03.2025 passed by this Court in connection with B.A. No.10 of 2025, the bail application of the aforesaid five accused persons namely Pradip Nama alias Gontu, Jogeswar Das, Bishu Ranjan Das, Babul Chandra Das alias Hotel Babul, Pinku Podder were rejected with certain observations. But, in spite of that Learned Court below granted bail to the said accused persons along with another accused namely, Manoranjan Tripura which appears to be violation of the order passed by this Court.

I have heard Learned Senior Counsel appearing for the applicant and Learned P.P. representing the State-respondent and perused the order dated 07.03.2025 passed by this Court in connection with Case No.B.A. No.10 of 2025.

Let the matter be admitted for hearing.

Issue notice upon the respondents.

Since, Learned P.P., Mr. R. Datta appears and accepts notice on behalf of the State-respondent, issuance of formal notice is waived.

The applicant may take step for service of notice upon respondent Nos.2 to 7 both by normal process and also by registered A/D post within 5 (five) days and file proof of service.

Registrar (Judicial), High Court of Tripura be asked to obtain a report from the concerned Learned Presiding Officer in connection with aforenoted case on or before the next date and to place the same before this Court under a sealed cover.

Also call for the record from the concerned Learned Trial Court.

Learned P.P. also be asked to produce the CD on the next date.

A copy of this order be supplied to Learned P.P. representing the State-respondent.
