Judgment
The Petitioner Nos. 1 and 2/Co-operative Society are represented in-person today through its Secretary and a Member.
The petitioners urge this Court to consider the situation which has arisen due to non-taking of the necessary steps for holding elections to the Board of
Directors ( BOD) of the Cooperative Society.
It is submitted in-person by Mr. Kali Prosad Sen, Secretary of the Petitioner No.1/Co-operative Society that steps are required to be urgently initiated
by the Co-operative Election Commission and the Cooperation Department of the State to hold the elections.
This Court is informed that the tenure of the existing BOD will expire on the 4th of April, 2018.
Having considered the submissions of the petitioners inperson, this Court, at the first instance, directs service of notice of this writ petition on Mr.
Srijan Nayek, learned Counsel who normally represents the Co-operative Election Commission and, on Mr. Sadhan Kumar Halder, learned State
Counsel for representing the State Co-operation Department.
Let the appointments of both Mr. Nayek and Mr. Halder along with their respective juniors to the brief be regularised.
Let Affidavits of Service be filed by the petitioners as directed above on the next date.
Let the matter next appear under the same heading “Mentioned Matterâ€(Group-V) on the 20th of March, 2018.
