Judgment
By filing the present petition under Section 438 of the
Code of Criminal Procedure, the petitioner has sought anticipatory
bail in FIR No.06 dated 09.01.2017, registered under Section 15 of
The Narcotic Drugs and Psychotropic Substances Act, 1985, at
Police Station Haibowal, Ludhiana City, District Ludhiana.
It is contended that the petitioner was not arrested from
the spot. The petitioner has been named in the FIR on the basis of
identification by the police officials. In pursuance of the order dated
08.02.2017, the petitioner has joined the investigation.
The learned State counsel, on instructions submits that
though the petitioner has joined the investigation, however, he is
involved in another FIR in the State of Uttar Pradesh and the status
of the same is not known.
Considering the fact that the petitioner has joined the
investigation, without expressing any opinion on the merits of the
case, the interim bail granted by this Court vide order dated
08.02.2017, is made absolute, subject to furnishing bail bonds/surety
bonds to the satisfaction of learned Chief Judicial Magistrate/Duty
Magistrate, concerned.
The petition stands allowed.
