The applicants have preferred these bail applications under Section 439 of the CrPC, as they have been arrested in connection with Crime No.88/2020, registered at Police Station Malkharoda, District Janjgir-Champa (C.G.) for the offence punishable under Sections 420, 409 & 188/34 of IPC, Sections 3 & 7 of the Essential Commodities Act, 1955, Section 3 of the Pandemic Act, 1955 and Section 53 of the Disaster Management Act, 2005.
The applicants have embezzled/misappropriated food grains meant for distribution to general public through fair price shop during COVID-19 pandemic period. The total embezzled quantity is 391.5 quintal rice, 5.97 quintal sugar and 11.46 quintal of salt amounting to Rs.13,19,452.59 paise.
Considering the nature of allegation, this Court is not inclined to release the applicants on bail at this stage. Accordingly, the bail applications are dismissed with liberty to the applicants to move again after 3 months.
