Judgment
Antony Dominic, J.—According to the Petitioners, they have purchased properties situated in Sy. No. 151 of Koorkkanchery Village of Thrissur Taluk as per Exts.P1 and P2 sale deeds. It is stated that when they attempted to construct a bund, that was prevented by the 3rd Respondent by issuing Ext.P5 stop memo. They have submitted Ext.P6 representation to the 2nd Respondent. Despite having filed Ext.P6 representation, so far proceedings have not been finalised. It is complaining of the above, the writ petition is filed.
Prima facie, it would appear that proceedings initiated against the Petitioners are under the provisions of Act 28 of 2008.
Having regard to the stop memo that is issued and Ext.P6 representation filed by the Petitioners, it is for the 2nd Respondent to finalise the proceedings. This the 2nd Respondent shall do as expeditiously as possible and with notice to the Petitioner. This shall be done, at any rate, within six weeks of production of a copy of this W.P (C) No. 3164 of 2011 judgment along with a copy of the writ petition.
Writ petition is disposed of as above.
