Heard both sides.
Mr.A.Sivasubramanian, learned Additional Government Pleader takes notice for Respondents 1 and 3 and Mr.D.Rajaboopathy, learned Government Advocate (Criminal Side) takes notice for Respondents 2 and 4.
The petitioner has come up with this Writ Petition to direct the respondents to consider the representation of the petitioner dated 18.08.2026 within the time fixed by this court. The learned Government Advocate (Criminal Side) appearing for the respondents submitted that, the petitioner's complaint has been attended by the 4th respondent police and registered a case in Crime No.146 of 2026 on 24.08.2026 under Section 191(2), 296(b), 115(2), and 351(2) of BNS and Section 4 of Tamil Nadu Prohibition of Harassment of Women (Amendment) Act 2002, which is pending for investigation.
The learned Government Advocate (Criminal Side) further submitted that, the complaint received from the counter party Mr. Prabu was registered in Crime No.147 of 2026 on 24.08.2026 for more or less similar offence, in addition to that additional provisions under Section 191(3) and 118(1) of BNS. Since it is a case and counter case, police is investigating both the cases and therefore, Court may pass any direction.
Recording the above submission, without going into the merits of both the cases, the 4th respondent police is directed to expedite the investigation in both the Crime Numbers and fix who is aggressor and mentioning the aggressor party, the police shall file final reports before the competent Court within a period of 3 months from the date of receipt of the copy of the order.
With the above directions, this Writ Petition is disposed of.
