The main contention of the learned counsel appearing on behalf of the petitioners is that the assignment of lands, made in favour of the petitioners, had been cancelled by the impugned order of the second respondent, dated 11.06.2002 which had been served on the petitioners on 14.07.2010, without issuing any notice to the petitioners and without giving them an opportunity of being heard. The learned counsel appearing on behalf of the respondents had not refuted the said contention made by the learned counsel for the petitioners. In such circumstances, the impugned order of the second respondent, dated 11.06.2002, is set aside. However, the petitioners shall appear before the Revenue Divisional Officer, Kodaikanal, Dindigul District, the second respondent herein, on 24.11.2010, and on the other subsequent dates as fixed by the second respondent, along with the relevant records, to establish their claims. Thereafter, it would be open to the second respondent to pass appropriate orders, in respect of the claims made by the petitioners, as per law.

This writ petition is disposed of with the above directions. No costs. Consequently, the connected Miscellaneous Petition is closed.
