Petitioner in this CMP seeks for a direction for early disposal of Civil Revision No.02 of 2022 pending in the Court of learned 2nd Additional District Judge, Puri.
Mr. Mohapatra, learned counsel for the Petitioner submits that the suit was filed by the General Secretary of the Petitioner-Parishad. Subsequently, an application was filed for withdrawal of the suit, which was allowed vide order dated 1st November, 2002 subject to payment of cost of Rs.250/-. As the cost was not paid within the stipulated period, the said application was dismissed for default. As such, the Petitioner filed an application under Section 151 CPC for restoration of the suit. The said application was rejected vide order dated 22nd January, 2022. Assailing the same, Civil Revision No.02 of 2022 has been filed, which is pending in the Court of learned District Judge, Puri. Although, all the Opposite Parties have already entered appearance, the suit is being adjourned awaiting photo copy of the case record of learned trial Court in TS No.319/589 of 1995/2001. Learned counsel for the Petitioner submits that the suit is of the year 1995 and unless the revision petition is considered at an early date, the petitioner will be highly prejudiced.
Taking note of submission made by learned counsel for the Petitioner this Court finds from the order sheet of the Civil Revision at Annexure-2 that the suit was last posted to 3rd November, 2023 awaiting LCR and hearing. However, this Court is not in a position to ascertain the present status of the Civil Revision.
In view of the above, this CMP is disposed of with a direction that in the event, the Petitioner moves an application before learned 2nd Additional District Judge, Puri for early disposal of Civil Revision No.02 of 2022 pending before it, such application shall be considered as expeditiously as possible preferably within a period of three weeks therefrom and learned Revisional Court shall proceed with the matter accordingly.
Urgent certified copy of this order be granted on proper application.
