RST.A(IBC)/3/2021- Learned Counsel for the Applicant and Learned Counsel for the Respondent appeared via video conference.
This is an application for the restoration of original Company Petition which was dismissed on 16.11.2021. Earlier Shri Debadatta Mahapatra appeared in this matter and due to his sudden demise, the Applicant could not pursue the matter resulting in the dismissal of this Company Petition on the ground that there is nobody to pursue the same. Having seen the Application and having gone through the pleadings, we are convinced with the reason given by the Learned Counsel for the Applicant and we hereby direct the original Company Petition be restored and taken back on record. Application allowed. List the Company Petition (IB)/67/2021 for filing counter on 06.07.2022.
