Judgment
Gita Gopi, J
Heard learned Advocate for the applicant/s Mr. Vibhuti Nanavati, who submits that the matters have been disposed of on the ground of smallness of amount observing that the First Appeals were raised for an amount less than Rs.1,00,000/-. It is further submitted that all the above Appeals are for an amount higher than Rs.1,00,000/-.
Learned Advocates appearing for the respective respondents Mr. Manish J. Patel and Mr. Paresh M. Darji confirm the said fact.
On perusal of the record, it appears the First Appeals referred in the captioned Miscellaneous Civil Applications are for an amount higher than Rs.1,00,000/-. Hence, the common order dated 07.02.2023 passed by this Court in the above stated First Appeals are recalled. The First Appeals Nos.690 of 2021, 699 of 2021 and 701 to 706 of 2021 are ordered to be restored to their original Files and the orders passed prior to 07.02.2023 would stand revived. The stay granted earlier, if any, would continue till the final disposal of the First Appeals.
Record and proceedings be called back again. Direct Service is permitted.
