Judgment
Heard Mr. Ranabir Ganguly, Assistant Manager, Oriental Insurance Company Ltd. Also heard Mr. M. Talukdar, learned counsel for the respondent
no.1.
Due to Covid-19 protocol in force, the matter has been taken up by remote video conferencing mode.
After negotiated settlement, the parties have agreed for a total settlement amount of Rs.15,00,000/- (Rupees fifteen lakh only) as full and final
settlement of all the claim of respondent nos. 1 to 3 in respect of the order and award dated 27.07.2018 passed by the learned Member, MACT,
Karimganj in MACT Case No.83/2015. Accordingly, the learned counsel for the respondent/ claimant nos.1, 2 and 3 has agreed that the appellant
deposit the entire settlement amount of Rs.15,00,000/-before the learned Member MACT, Karimganj within a period of 4 (four) weeks from today.
On such deposit being made, the learned Member MACT, Karimganj shall convert a sum of Rs.7,00,000/- (Rupees seven lakh only) into fixed deposit
for a period of 3 (three) years in equal proportion in the names of the respondent/ claimant nos.1, 2 and 3 and the balance amount shall be disbursed to
the respondent/ claimant nos.1, 2 and 3 in equal proportionate on being satisfied as regards to their identity.
In the event the settlement sum is not paid within the time allowed, it would be open to the respondent/ claimant nos.1, 2 and 3 to enforce the
settlement amount.
On furnishing proof of the deposit of the entire settlement amount, the Registry shall release the statutory deposit made by the appellant.
This interlocutory application along with unregistered MAC Appeal Sl. No. 15561/2018 stands disposed of in this Lok Adalat.
