Judgment
This is an application filed by the Applicant/Erstwhile RP under Section 60(5) of IB Code, 2016 read with Rule 11 of NCLT Rules, 2016 with the following prayers:-
a. That this Hon'ble Tribunal be pleased to direct Respondent No.1 or Respondent No.2 to disclose their bank details so that the amount payable to Respondent No.1 can be deposited in their account;
b. In the event of failure of Respondent 1 or 2 disclosing their bank account this Hon'ble Tribunal may be pleased to allow the Applicant to pay the Operational creditor M/s BNK Power Solution Pvt. Ltd. as per the order of priority in the resolution plan.
c. That this Hon'ble Tribunal be pleased to allow the applicant to deduct a sum of Rs.60,000/- plus taxes as applicable covering cost and fees for this Application and remit the net amount as directed by this Hon'ble Tribunal.
d. Any other order or direction that this Hon'ble Tribunal may deem fit and proper.
Let notice be issued to the Respondents by the Registry, returnable by next date. The Applicant is also directed to collect the notice from the Registry within three days and serve upon the Respondents along with copy of this order through Registered Ad Post / Speed-post / Dasti Mode as well as on the registered e-mail ID of the Respondents registered with the MCA within seven days.
The Respondents may file reply, if any, within seven days from the date of receipt of notice. Thereafter, rejoinder, if any, be filed within seven days.
Proof of Service be filed by way of an affidavit before the next date of hearing.
