This is a petition for quashing of the First Information Report Annexure P1, which must succeed on the short ground of delay and inaction on the part of the State of Haryana.
The First Information in the instant case was registered on 6121977. Nothing was done for more than a decade after the lodging of the First Information Report. The prosecution had been granted number of opportunities to present the challan in Court which was done only on 29.10.1987 Even on this date incomplete challan was out up in the sense that some of the copies were not complete. The case was adjourned for the supply of legible and complete copies. The guidelines laid down by a Full Bench of Patna High Court in Maheshwardhari Singh and another v. State of Bihar, AIR 1986 Patna, 324 cover the present case for quashing the First Information Report in which after discussing the various aspects of the matter their Lordships fixed the outer Limit of 7 years. The ratio of law as was laid down in the Full Bench of Patna High Court was later on followed by this Court in several judicial pronouncements to which reference is wholly unnecessary as the same has not been disputed by the State Counsel. This being the position of law and in view of the delay and inaction on the part of the State of Haryana the First Information Report is hereby quashed and the petition for quashment is allowed.
