This is the First bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 78/2026 registered at Police Station : Balrampur, District : Balrampur-Ramanujganj (C.G.) for the offence punishable under Sections 318(2), 319(2), 336(3), 338, 340(2) and 61(2)(a) of Bhartiya Nyaya Sanhita, 2023 and Sections 66C and 66D of Information and Technology Act.

2.

Pursuant to a complaint by Patwari Satyajivan Ravi, an investigation revealed that accused candidates fraudulently obtained forged Chhattisgarh domicile certificates to benefit from lower C.R.P.F. recruitment cut-off marks. The investigation disclosed that co-accused Omprakash Chandravanshi allegedly fabricated the domicile certificates for the accused persons, including the applicant, by misusing the documents of one Deepak Chaurasia. Specifically, the applicant approached Vivek Tomar, who, with the assistance of Omprakash Chandravanshi, allegedly prepared a forged certificate in the name of Tukeshwar using Deepak Chaurasia’s documents and delivered it to the applicant; a forged certificate was likewise prepared for Vivek Tomar. Based on documentary evidence and call detail records, the accused were charge-sheeted before the competent Court.

3.

Learned counsel for the applicant submits that the applicant has not been alleged to have personally obtained any appointment, monetary benefit, or other advantage through the use of the alleged forged documents, and that he has no acquaintance or connection whatsoever with the co-accused persons. He further submits that co-accused persons, namely Sumit Singh and Aakash Sharma, have been enlarged on bail by the coordinate Bench in MCRC/7686/2026 and MCRC/7817/2026 respectively. He also submits that the charge-sheet has been filed, the applicant has been in jail since 28.05.2026, and the conclusion of the trial may take some time; therefore, he prays for the grant of regular bail to the present applicant.

4.

On the other hand, the learned State counsel opposes the bail application of the present applicant and submits that allegations against the applicant are serious in nature, therefore he is not entitled for grant of regular bail.

5.

I have heard learned counsel for the parties and perused the case diary.

6.

Taking into consideration the nature of the allegations, the fact the charge-sheet has already been filed and the applicant is in custody since 28.05.2026, this Court is of the view that no further custodial interrogation of the applicant is required. More particularly, co-accused persons, namely Sumit Singh and Aakash Sharma have been enlarged on bail by the co-ordinate Bench in MCRC/7686/2026 and MCRC/7817/2026 respectively. Therefore, considering the principle of parity and without commenting upon the merits of the case, the applicant is also entitled to be enlarged on bail.

7.
