It is submitted by petitioner in person that the petitioners had applied for membership of the society, they are unaware of the outcome of the application made, however, in the proposed voter list (Annex.14), the names of the petitioners have not been reflected without any justification.
It is submitted that elections are due and, therefore, the respondents be restrained from holding the elections based on the proposed voter list.
A perusal of the list (Annex.14) indicates that the same is only a ‘proposed voter list’. After publication thereof, whether the petitioners have raised any objection or not is not known, as there is nothing available on record to indicate that petitioners have raised objection to the proposed voter list.
Without raising objection before the competent authority regarding the absence of their names, approaching this Court raising grievance qua the non-inclusion, cannot be countenanced.
The petitioners would be free to approach the competent authority/s, which have issued the proposed voter list (Annex.14) raising their objections and it is expected of the authority/s to pass appropriate orders on the said objections, if filed before the elections takes place.
With the above directions, the petition stands disposed of.
