WHEN the case was taken up for hearing, the Counsel for the United Insurance Co. stated that he has filed preliminary objections to the maintainability of the Complaint. We observed that we decide the controversy between the parties in one stroke and not piece-meal. The Counsel for the Insurance Company prayed for time to file a detailed counter affidavit. The Company shall also indicate by a speaking order, the grounds in which it chore to repudiate the claim of the Complainant. A letter dated 15.11.90 was placed before us by the Insurance Company. The letter also refers to some other letter dated 15th July, 1990 which was not placed before us. We find that the repudiation on 15th November, 1990 is not by a speaking order. It is expected that the order shall indicate the precise reasons on which claim is repudiated. We accordingly direct the Insurance Company to indicate grounds on the basis of which repudiation has been done. The order shall also indicate terms of the policy which have been violated resulting in repudiation of claim.

WE accordingly direct that the written statement and the speaking order be filed by 31.12.92. The case shall come up for hearing on 27.1.93. O.P. directed to file written statement.
