Heard on I.A. No.6409/2020, which is an application for exemption from affixing notary and memo tickets.

On due consideration, aforesaid application is allowed and the petitioner is exempted from affixation of notary and memo tickets.

This petition under Article 226 of the Constitution of India has been filed by the petitioner, who is working as Peon being aggrieved of the inaction on the part of the respondents to decide his representation dated 24.04.2018 (Annexure P/9), wherein he is claiming regularization of his services with effect from his first appointment upon completion of three years.

Learned counsel for the petitioner has submitted that similarly situated employees have already been granted the benefit of regularization and in this regard various judgments have been passed by this Court filed as Annexure P/10. Counsel has further submitted that although the petitioner has submitted a representation in this regard to the respondent on 24.04.2018 (Annexure P/9) but the same is still pending.

In the circumstances, without expressing any opinion on the merits of the case, the petition is disposed of with a direction to the petitioner to submit a fresh representation alongwith all the relevant documents before the respondent No.3 within a period of two weeks from the date of receipt of certified copy of this order and on receipt of such representation, the same shall be decided by the respondent No.3 in accordance with law, taking note of the judgements passed by this Court (Annexure P/10) within a further period of three months therefrom, by passing a reasoned and speaking order.

Accordingly, the petition stands disposed of.
