Shri Anoop Nair, learned Counsel for Respondents.

The Respondents have filed return; wherein, they have stated that w.e.f. 29.10.2004 a new scheme, viz. "Scheme for Payment of Ex-Gratia (Lump Sum Amount)" to the family of those employees who die in harness or seek premature retirement due to. incapacitation before reaching the age of 55 years" has come into vogue.
