Soumen Sen, J.—This matter has come for corrections of typographical errors crept in the order dated 2nd August, 2013. At page 19 of the judgment and order the paragraph starting with "From a reading....." should read as follows: "From a reading of various textbooks on the subject, namely The Law and Practice of Banking by J. Milnes Holden, Elinger''s Modern Banking law and Paget''s Law of Banking the principles of law that emerges are stated hereinafter." At page 20, in the last sentence of the first new paragraph the word "same" should be replaced by "said" and it should read as "The said view is explained in Welch v. Bank of England, 1955 Ch.508:--

At page 21, the last paragraph should start as "the said section was based" instead of "The said action in the instant case was based

At page 22, in the first opening paragraph, instead of "On the basis" it should read as "On that basis".

The Department is directed to incorporate the aforesaid correction in the judgment and decree dated 2nd August, 2013 and the decree shall be drawn up after incorporating the said judgment. In the event the certified copies have already been issued, the parties are directed to return the certified copies so that a fresh certified copies may be furnished to the parties.

The server copy shall also be corrected accordingly.

The Registrar, High Court, Original side is directed to ensure that such corrections are incorporated in the server copy.

Assistant Registrar, attached to this Court is directed to communicate this order to the Registrar, High Court, Original side, the department concerned as also the Computer Section for compliance. Registrar, High Court, Original Side, Department and all parties concerned are to act on a signed photocopy of this order on the usual undertakings.
