Petitioner Mr. Om Prakash impugns order dated 14.02.2019, whereby the leave to defend application filed by the petitioner has been dismissed and an eviction order passed.
Respondent had filed the subject eviction seeking eviction of the petitioner on the ground of bonafide necessity under Section 14(1) (e) of the Delhi Rent Control Act, 1958, from one room/shop on the ground floor of the property bearing No.5266, Kolhapur Road, Kamla Nagar, Delhi-110007, more particularly as shown in red colour in the site plan annexed with the eviction petition.
Petitioner Mr. Om Prakash who is present in Court prays for leave to withdraw the petition. He submits that he is willing to surrender the peaceful, vacant possession of the tenanted premises to the respondents in Court today. As a token of handing over possession he has handed over the keys of the tenanted premises to learned counsel for the respondents.
Learned counsel for the respondents accepts the keys subject to verification of the tenanted premises. Learned counsel further, under instructions, submits that all claims of the respondents against the petitioner are fully and finally settled and now there is no due or claim against the petitioner of any nature.
In view of the above, the petition is dismissed as withdrawn.
