It is submitted by learned counsel for the petitioner and agreed to by the counsel for the respondents that controversy involved in the present writ petition is squarely covered by a decision rendered by this Court in S.B.C.W.P. No.5218/2021 (Smt. Munni Devi Vs. The State of Rajasthan & Ors.). Smt. Munni Devi’s case (supra) had been decided vide order dated 27.07.2021 relying upon the judgment passed in Sohanlal Mathur Vs. State of Rajasthan & Ors. (S.B.C.W.P. No.3631/2008). Sohanlal Mathur’s case (supra) has been affirmed by Hon’ble Apex Court in SLP (Civil) No.14932/2012.

In view of the submissions made, the present petition is allowed and the respondents are directed to grant the selection grade to the petitioner to which he is entitled strictly in terms of the judgment rendered in the case of Sohanlal Mathur’s case (supra).

Counsel for the respondents states that the only difference in Sohanlal Mathur’s case (supra) and the present petitioner is that the present petitioner would be entitled to the pay scale of Rs.5,000/- to Rs.8,000/- on completion of 27 years of service as the 3rd Selection Grade.

The petitioner herein shall file his representation/claim petition claiming the pay scale in terms of the judgment rendered in Sohanlal Mathur’s case (supra) within a period of two weeks and the respondents shall do the needful within a period of eight weeks from receiving the same.
