By way of this petition, the petitioner(s) have assailed the Provisional Attachment Order No. GNZO/19/2025 dated 27.06.2025 (Annexure P-16) passed u/s 5 of the Prevention of Money Laundering Act, 2002 (PMLA).
Learned counsel for respondent/ED, who appears virtually, informs that the said Provisional Attachment Order has since been confirmed on 17.12.2025 qua the petitioner (Om Parkash). Copy of the same is placed on record and marked as Annexure ‘X’.
In view of above, since there are many disputed questions of fact raised by the petitioner in his grounds of challenge in this petition, it would be appropriate that the same are raised before the Appellate Forum u/s 26 of the PML Act.
Therefore, this Court declines interference on merits and relegates the petitioner(s) to file an appropriate appeal in accordance with law, which, if filed within a period of 30 days from today, shall be entertained on merits without being dismissed on limitation alone, provided the petitioner(s) comply with all the pre-requisites of Section 26 of the PML Act.
Disposed of.
