Judgment
K.C. Garewal, J.—The appellant was convicted for possession of 50 Kgs of poppy husk vide judgment of the trial Court dated July 31, 1999. Appellant has filed present appeal on August 25, 1999. Prior to his conviction the appellant has been in custody since November 29, 1996 meaning thereby that the appellant has been continuously in custody for about 4-1/2 years including the period of one year & 11 months during the appeal. As the appeal is not likely to heard soon the appellant shall be admitted to bail on his furnishing bail bond in the sum of Rs. 50,000/- with two sureties in the like amount to the satisfaction of the Chief Judicial Magistrate, Fatehabad. The appellant be kept under surveillance by the police of Police Station Bhattu Kalan. He shall report before the S.H.O. on the first date of every month. In case the appellant is found to have committed any offence during the pendency of the appeal, his bail shall be liable to be cancelled.
Appeal allowed.
