Om Parkash and Others vs State of Punjab and Others

K.C. Puri, J.—This is a petition u/s 482 Code of Criminal Procedure for quashing FIR No. 66 dated 22.4.2008, under Sections 420, 467, 468, 471, 193, 120-B IPC registered at Police Station Sirhind, District Fatehgarh Sahib, on the basis of compromise.

The report of the trial Court was called for. The report has been received in which it is mentioned that parties have arrived at a compromise. The compromise has also been placed on the file.

Petitioners were convicted in the said FIR under Sections 420, 467, 468, 471, 120-B IPC by the Additional Chief Judicial Magistrate, Fatehgarh Sahib. The appeal against the said judgment is pending. A compromise has been effected in that appeal. The allegation against the Petitioners is that loan has been raised from the bank inspite of sale of the property. The loan amount is stated to have been paid. The civil matter is also stated to have been compromised.

So, in view of compromise and in view of authority reported as Kulwinder Singh and Ors. v. State of Punjab and Ors. 2007 (3) RCR 1052, the abovesaid FIR stands quashed. Further proceedings, in pursuant to that FIR also stand quashed. The accused stand acquitted in view of the compromise.
