Judgment
T.R. Ramachandran Nair, J.—The petitioner alleges non compliance of the directions in Annexure-A1 Judgment. The matter was being adjourned from time to time to await the order passed by the District Educational Officer.
The learned Government Pleader produced before me for perusal a copy of the proceedings, namely, Order No.B3/3210/2011, dated 03/12/2011. Therein, the District Educational Officer has found that the Management is solely responsible for the delay in settling the claim by neglecting the orders of the Department and Government and hence with regard to the payment of salary and allowances for the period in question, a direction is issued to recover the same from the Management as stipulated in Rule 7(4) of Chapter III Kerala Education Rules.
Learned counsel for the petitioner submitted that the Department should have paid the salary and then recovered it from the Management.
If the petitioner is aggrieved by the directions in the above Order, she will have to challenge the same before appropriate authority.
Without prejudice to the said right of the petitioner, the Contempt of Court Case is closed.
